As a result of the exhaustive investigation, the specialists of Atestados de la Benemérita have been able to conclude that the accident occurred as a result of manifestly reckless driving by the motorcyclist that caused serious injuries to the cyclist. The team of Atestados del Sector / Subsector de Traffic de Murcia has investigated and brought to justice the enduro motorcycle driver, who has been instructed as the alleged perpetrator of the crimes of serious carelessness and against road safety , for reckless driving. The investigated and the proceedings have been placed at the disposal of the Investigating Court of Molina de Segura (Murcia). Driving a motor or moped vehicle with manifest recklessness, putting in danger the life or integrity of people, constitutes a crime against road safety of article 380 of the Penal Code, punishable with prison terms of 6 months to 2 years and the deprivation of the right to drive motor vehicles and mopeds for longer than 1 and up to 6 years. The crime of serious carelessness injuries with a motor vehicle is included in article 152 of the Penal Code and can be punished with a prison sentence of 3 months to 3 years and deprivation of the right to drive motor vehicles and mopeds from 1 to 4 years. The intervention of the Astastados team of the Traffic Sector / Subsector of the Civil Guard of Murcia in the study and development of the road accident, together with the thorough performance of the technical-ocular inspection carried out at the scene, have allowed the reconstruction of the accident dynamics and, in this way, determine the alleged responsibilities of the motorcyclist. In this sense, the Civil Guard appeals to the citizens so that, when they witness or become aware of a traffic accident, they take note of as many data as possible, especially the type, characteristics and registration of the vehicle, and communicate them to the Guard Civilian without delay, in order to facilitate the police investigation and prevent such regrettable events as these from going unpunished.
