Statement from the Councilor for Citizen Security and Local Police of the Molina de Segura city council (09/10/2020)

In response to the note sent by union representatives of the Molina de Segura City Council pursuant to the resolution for the recovery of hours not provided by agents of the Local Police of the town during the State of Alarm, the Councilor for Citizen Security and Local Police , Julia Fernández Castro, please make the following clarifications that highlight the lack of veracity of the information provided in the aforementioned note: Once the State of Alarm has started, it is the union representatives themselves who make the proposal to change the schedule, and therefore, the quadrant to give greater security of social distance in the relays, with the approval of the delegates of prevention of occupational risks, in order to prevent the spread of COVID19. When this proposal arrives to the Government Team, it sees it fully as a guarantee of its job security and accepts the aforementioned change in schedule proposed by the union representatives of the Local Police, but with the condition that the deficit that would be generated in the annual calculation of hours would be recovered once the Alarm Status has ended. The negotiation was carried out at all times between the union representatives of the Local Police and the Headquarters of the Service and took place in the last week of March. When the union representatives learned of the decision of the Government Team to accept this rotation in the shifts proposed by themselves, which was entirely positive to safeguard the safety and health of the agents and their families, but recoverable, they announced their decision not to accept this change of quadrants and continue as they were, at which point their health and all the arguments used to request the change of the quadrant seem to disappear. It was then that the decision was made to implement the proposal suggested by the unions, but with the condition of negotiating the recovery, once the State of Alarm had ended.

The time that the agents were working 2 days in 12-hour shifts and resting 6 days in a row, has caused an hourly deficit of an average 120/140 hours per agent, and has supposed the municipal coffers about 700,000 euros paid and collected by the agents they have not done. All public employees have recovered the hours they stopped working in the state of alarm and the non-recovery of these hours by the Local Police would be a comparative offense towards them. In September a General Negotiating Table was convened to negotiate the recovery of the hourly deficit and the union party unilaterally denied negotiating anything at all times, claiming that they had nothing to recover. There are two reports, one from the Legal Department and the other from the Head of Human Resources, which include the obligation to recover this hourly deficit, which are perfectly known by union representatives and by the rest of the Corporation's political groups, as which are sent prior to the convocation of the General Table. Once the legal report of the Head of Human Resources has been made, the Resolution is made from the Department of Citizen Security for the recovery of this hourly deficit, which will be launched this October and has until March 31 for its recovery, basically, covering the services of markets and entrances and exits of schools, in the mornings. As can be seen, the Local Police Councilor affirms that "all the decisions were taken to guarantee the safety of the agents and proposed by them, but with the condition of recovering the hours not borrowed, which amount to 700,000 euros of the municipal coffers.

They are asked the same as any municipal worker; the opposite would be a comparative offense.

And it is a decision that, in addition, has the support of two legal reports.
