Another service provided by the municipality of Molina is the processing of the claim of mortgage expenses.

This is done through the legal service of OMIC.

The speakers are: Juan Gómez, banking director, Jesús Montoia (OMIC municipal technician), and Simon Tudela, legal adviser to OMIC.

Also involved is the Councilor for Consumer Affairs, Esther Sánchez.

Since the Land Cluster Management service was launched, the Department of Consumer Affairs has processed more than 300 complaints to mediate the claim of cash.

"Now, thanks to the online simulator, we are going to make it easier for the Molinians to consult if the offer that their bank has made to return the money is in line with its right," explains the Councilor for Consumer Affairs.

The same link explains the documentation required for the claim and some frequently asked questions that will help those interested to solve their doubts about the process of claiming their money.

Floor Clause

The ground clause is a contractual clause that establishes a minimum limit to the interest to be applied in the quota, even if the interest rate falls.

It is a clause that benefits the bank and hurts the individual who has applied for the loan, since when the rates fall, the clause prevents it from being transferred to the monthly fee.

In Spain, cases were declared unlawful and abusive by decision of the Supremode Tribunal May 9, 2013, although it limited the repayment of the amounts illegally collected by the banks from the date of the sentence.

The Court of Justice of the European Union ruled in a judgment of 21 December 2016 that banks and savings banks are obliged to pay back all the money collected by land clauses since the signing of the real estate mortgage.

Based on the ruling, on Friday January 20, the Government of Spain approved the Royal Decree establishing an extrajudicial procedure so that consumers can recover their money.
